Terms of Service

These Terms of Service ("Terms") govern your use of Momentum (the "Service"), operated by Momentum ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.
1. What Momentum Does
Momentum is a scheduling and payments platform that helps independent personal trainers ("Trainers") run paid one-on-one and small-group training sessions with their clients ("Clients"). Momentum provides the scheduling, payment processing, communication, and reporting tools that connect Trainers and Clients — it does not employ Trainers, and it does not supervise, certify, or guarantee the quality or safety of any training session.
2. Accounts & Eligibility
You must be at least 18 years old to create a Trainer account. Anyone booking sessions on behalf of a minor client must be that minor's parent or legal guardian. You're responsible for keeping your account credentials secure and for all activity that happens under your account.
3. Trainer Responsibilities
As a Trainer, you're solely responsible for the training sessions you run, including their safety, supervision, and suitability for the clients involved, and for holding any certifications, insurance, or facility permissions your training location requires. Momentum is not a party to the training relationship between you and your Clients.
4. Payments & Stripe
All payments made through Momentum are processed by Stripe, a third-party payment processor. By using Momentum's payment features, you also agree to Stripe's terms of service. Momentum does not store your full payment card details. Funds collected from Clients are paid out to Trainers according to Stripe's standard payout schedule, less Stripe's processing fees.
5. Subscription & Fees
Trainer accounts are billed on a recurring monthly subscription as described on our Pricing page. Subscriptions renew automatically until cancelled. You can cancel at any time; see our Refund Policy for how cancellations and refunds work.
6. Assumption of Risk
Personal training carries an inherent risk of injury. Momentum does not provide medical, fitness, or safety advice, and is not responsible for injuries, disputes, or outcomes arising from a training session booked through the Service. Clients participate in sessions at their own risk.
7. Prohibited Conduct
You agree not to use Momentum to process payments unrelated to legitimate personal training services, to harass or defraud another user, to circumvent the Service's payment system to avoid fees, or to violate any applicable law.
8. Disclaimers & Limitation of Liability
The Service is provided "as is," without warranties of any kind. To the fullest extent permitted by law, Momentum is not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including disputes between Trainers and Clients.
9. Termination
We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to other users or to the Service.
10. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we'll post the updated Terms here with a new effective date.
11. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-law principles.
